Show Snap Layers Affected by Layer Scale?

I have 5 Design Layers with scale as follows:

DL1 1:50 Actual Boarder (not a viewport of my boarder)

DL2 1:50 Viewport of another sheet

DL3 1:50 Viewport of another sheet

DL4 1:50 Viewport of another sheet

DL5 1:100 Viewport of another sheet

DL1 is the only layer that I have set to visible so when I View each "active layer" I can see DL1 also which is my boarder. This method haas worked fine for ages but for some reason now I am experiencing a glitch.

When I Have either DL2, DL3 or DL4 set to active all is fine because they are the same slace as DL1. When I view DL5 (1:100 DL1 does not show, If I change from 1:100 to 1:50 go down a layer and then back up a layer DL1 appears, If i change back to 1:100 DL1 shows but at 1:100, if I then go down a layer and back up a layer DL1 disappears again.

What am I doing wrong?
